These terms apply to your use of the Elevome website at elevome.com, operated by Elevome LLC, a Minnesota limited liability company ("Elevome," "we," or "us"). By using the site, you agree to them.
They're intentionally short. The specifics of any project we do together live in a separate written agreement, and where that agreement conflicts with anything here, that agreement controls.
Using this site
You're welcome to browse the site and get in touch. Please don't misuse it — for example, by attempting to disrupt or overload it, accessing it or its underlying systems in unauthorized ways, scraping it at scale, or using it for anything unlawful. You need to be at least 18 and using the site for business purposes.
Not a binding offer
The information on this site — including descriptions of what we build and how we work — is for general information. It isn't a contract or a guaranteed offer. Any engagement only begins once we've agreed on scope and terms in a separate written agreement.
Content and ownership
The content, design, branding, and code on this site are owned by Elevome unless stated otherwise. You may view and print pages for your own reference. Please don't copy, resell, republish, or reproduce them without permission.
No warranties
The site is provided "as is" and "as available," without warranties of any kind, express or implied — including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We work to keep it accurate and available, but we can't guarantee it will always be error-free, current, secure, or uninterrupted.
Limitation of liability
To the fullest extent permitted by law, Elevome will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business, arising out of or relating to your use of this website — even if we've been advised such damages are possible.
Our total liability for any claim relating to this website will not exceed one hundred US dollars ($100). This cap applies to the website only; liability for work performed under a signed agreement is governed by that agreement.
Some states don't allow certain limitations, so parts of this section may not apply to you. Nothing here limits liability that can't legally be limited.
Indemnification
If your use of this site breaks these terms or the law, and that leads to a third-party claim against us, you agree to cover the reasonable costs we incur as a result, including legal fees.
Links to other sites
Where we link to third-party websites or tools, we do so for convenience. We're not responsible for their content or practices.
Suspending or ending access
We may change, suspend, or discontinue any part of this site at any time, and we may restrict access if we believe someone is misusing it. These terms continue to apply to any use that has already happened.
Governing law and where disputes are heard
These terms are governed by the laws of the State of Minnesota, United States, without regard to its conflict-of-laws rules. Any dispute relating to this website will be brought exclusively in the state or federal courts located in Minnesota, and you agree that those courts have personal jurisdiction over you.
If part of these terms doesn't hold up
If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the rest of these terms stay in full effect. If we don't enforce a provision straight away, that isn't a waiver of our right to enforce it later.
The whole agreement
These terms, together with our privacy policy, are the entire agreement between you and Elevome regarding this website, and they replace any earlier understandings about it.
Changes
We may update these terms from time to time. When we do, we'll revise the "last updated" date above.
